These are launch templates and should be reviewed by qualified counsel before public use, especially for Europe, taxes, refunds, trademarks, and data processing.
Terms
Terms of Service
These Terms govern access to Erponix websites, trials, subscriptions, demos, support, and hosted software services. By using Erponix, the customer agrees to use the service lawfully, provide accurate account information, protect login credentials, and comply with applicable payment and acceptable-use requirements.
Subscriptions and trial
Self-serve plans include a 14-day trial unless otherwise stated. Paid subscriptions renew monthly or annually based on the selected billing period. Annual subscriptions are priced 20% lower than monthly equivalent pricing.
Customer responsibilities
The customer is responsible for users, roles, permissions, uploaded data, accounting configuration, tax settings, and the legality of business records entered into Erponix.
Service changes
Erponix may improve modules, settings, integrations, and pricing pages over time. Material contractual changes should be communicated before they apply to existing paid customers.
Privacy
Privacy Policy
Erponix may process account details, contact details, company information, billing records, support messages, technical logs, and product usage events to provide the ERP service, support customers, secure accounts, improve the product, and comply with legal obligations.
Data categories
- Account data: name, email, company, role, plan, login metadata.
- Customer content: ERP records such as invoices, payments, products, employees, leads, and reports entered by the customer.
- Support data: tickets, messages, attachments, diagnostics, and implementation notes.
- Website data: form submissions, cookie preferences, analytics events if consented.
Rights
Depending on location, users may request access, correction, deletion, export, restriction, objection, or withdrawal of consent. Requests should be sent through the contact page or the designated privacy contact.
Europe
GDPR Compliance Statement
For customers subject to the GDPR, Erponix should define whether it acts as controller or processor for each processing activity. For customer ERP content, Erponix will generally act as processor and the customer will generally act as controller.
Compliance commitments
- Process customer content only to provide and secure the service, or as instructed by the customer.
- Maintain reasonable technical and organizational security measures.
- Support customer requests for data access, deletion, export, and correction where technically feasible.
- Use subprocessors only under written obligations appropriate for data processing.
- Notify customers of confirmed personal data breaches without undue delay where required.
DPA
Data Processing Agreement
This DPA applies when Erponix processes personal data on behalf of a customer. The customer is the controller and Erponix is the processor for customer content unless an order form states otherwise.
Processing details
- Subject matter: hosted ERP, support, onboarding, and related services.
- Duration: subscription term plus deletion or return period.
- Nature and purpose: storage, retrieval, support, reporting, security, backup, and service operations.
- Data subjects: customer employees, contacts, vendors, customers, leads, and authorized users.
- Personal data: contact details, business records, HR records entered by customer, support data, usage logs.
Subprocessors and transfers
Before launch, Erponix should publish a current subprocessor list and identify hosting regions, support locations, and any transfer mechanism used for data outside the EEA/UK.
License
End User License Agreement
Erponix grants authorized users a limited, non-exclusive, non-transferable right to access and use the software during an active subscription, subject to plan limits, documentation, and acceptable-use rules.
Restrictions
Users may not reverse engineer hosted software, bypass access controls, resell access without written permission, upload unlawful content, or interfere with the service or other customers.
Ownership
Erponix and its licensors retain ownership of the software, design, code, documentation, trademarks, and platform materials. Customers retain ownership of their customer content.
Brand
Trademark and Brand Use
Erponix is a brand used for the ERP product and related services. Do not claim "registered trademark" on the public site unless an official registration number and jurisdiction are confirmed.
Allowed use
Customers may refer to Erponix by name to identify the product they use. Partners may use approved logos and screenshots only under written brand guidelines.
Not allowed
No party may imply ownership, sponsorship, endorsement, or certification by Erponix without written permission. Do not modify logos, use confusingly similar names, or register domains that imitate the brand.
Refunds
Refund Policy
Erponix offers a 14-day trial so customers can evaluate the product before paid use. Monthly fees are generally non-refundable after a paid billing period begins, unless required by law or agreed in writing.
Annual plans
Annual subscriptions are discounted by 20%. Refunds for annual subscriptions should be handled according to the signed order form. A suggested public policy is a prorated credit, not cash refund, after the first 14 paid days.
Enterprise services
Implementation, migration, customization, and training services may be non-refundable once work begins, unless a separate statement of work says otherwise.
